Landlord and Tenant Law
We can advise either landlords and tenants about leases and tenancy agreements. We also have a great deal of experience in both residential and commercial agreements.
We can advise on and draft commercial leases for business premises. One thing to consider right at the start is the protection a tenant of business premises can have under the Landlord and Tenant Act 1954. It is possible to exclude these provisions with an application to the Court. Other things to consider include rent review clauses and break clauses.
We can also advise on and draft tenancy agreements for residential properties. The most common type of tenancy agreement for flats and houses is an "Assured Shorthold Tenancy". Landlords have to pay particular care in this area due to the Protection from Eviction Act 1977 and a properly drawn up notice has to be served on a tenant before eviction proceedings can be commenced.
Disputes between landlords and tenants often revolve around arrears of rent and the condition of premises. We can help resolve these matters with practical advice on the law in these areas. In both residential and commercial properties, evicting a difficult tenant can be a complicated process and detailed advice can save time and money later on.
